Terms of Use

1. Accepting these terms

By downloading, installing or using the Hairset mobile application (the “App”), the website at https://hairset.app or any related service (together, the “Service”), you agree to these Terms of Use (“Terms”) and to our Privacy Policy, which is part of them. If you do not agree, do not use the Service. The Service is provided by Hairset (“Hairset”, “we”, “us”).

If you downloaded the App from Apple’s App Store, Apple’s Licensed Application End User License Agreement also applies; where it conflicts with these Terms, these Terms prevail to the extent permitted.

2. Eligibility and accounts

You must be at least 13 years old (or 16 where local law sets that age) to use the Service, and at least 18 to make a purchase or have a parent or guardian’s permission. When you first open the App we create an anonymous account tied to your device. You may optionally link it with Sign in with Apple to restore your looks on a new device. You are responsible for keeping your device and Apple ID secure and for everything that happens under your account.

3. The Service and AI results

Hairset uses generative AI to render haircuts, hair colors, beards and related styles onto a photo you provide, and to estimate face shape, color season and hair texture. These are simulations for inspiration and planning. They are not a guarantee of how a real haircut, color process or beard will look, grow or behave, and they are not professional advice. Real results depend on your hair, your stylist and the products used. Always discuss suitability, allergies and colour tests with a qualified professional.

AI output can be imperfect or occasionally inaccurate. We work to improve quality, and the App lets you re-render a look once for free when a result is clearly off; we do not otherwise promise a specific outcome from any render.

We may add, change or remove features, styles or catalog content at any time. Some features require a network connection.

4. Looks, Hairset+ and look packs

4.1 Looks

A “look” is one AI render on your photo. New accounts receive 3 free looks. Browsing the catalog, the analysis, comparing and saving do not consume looks. A look is consumed when a render is started, whether or not you later save it.

4.2 Hairset+ (auto-renewing subscription)

• Hairset+ is offered monthly ($9.99) and yearly ($79.99), in US dollars; your App Store shows the price in your local currency and applicable taxes.
• Hairset+ includes 30 looks per monthly period (yearly plans receive 30 looks each month), access to every style, color and tool, and priority rendering. Unused looks do not roll over.
• Payment is charged to your Apple ID account at confirmation of purchase. The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends at the then-current price.
• You can manage or cancel your subscription in your device’s Settings → Apple ID → Subscriptions. Cancelling stops future renewals; you keep access until the end of the paid period. Deleting the App does not cancel a subscription.
• If a free trial or introductory offer is available, any unused portion is forfeited when you purchase a subscription.

4.3 Look packs (one-time purchase)

A look pack adds 10 looks to your account for $4.99 as a one-time, consumable purchase. Pack looks do not expire, are used after any Hairset+ monthly looks, and are tied to the account that bought them.

4.4 Refunds

Purchases are processed by Apple, and refund requests are handled by Apple under its policies at reportaproblem.apple.com. Looks consumed before a refund are not restored. Nothing here limits statutory rights you may have as a consumer.

4.5 Price changes

We may change prices for future periods. Apple will notify you of a subscription price increase in advance and, where required, ask for your consent before it applies.

5. Your photos and acceptable use

You keep all rights to the photos you upload. You grant us a limited, non-exclusive licence to store and process them solely to provide the Service to you, as described in the Privacy Policy. You agree that you will:

• only upload photos of yourself, or of another person who has given you clear permission (for a child, only if you are their parent or legal guardian);
• not upload photos of public figures, strangers or anyone without their consent, and not use the Service to harass, impersonate, deceive or defame anyone;
• not upload sexual, violent, hateful or otherwise unlawful content;
• not present a render as an unedited photograph in any context where that could mislead (for example identification or advertising claims);
• not reverse-engineer, scrape, overload or interfere with the Service, resell looks, or bypass purchase or usage limits.

We may remove content and suspend accounts that break these rules. You are responsible for how you use and share your renders.

6. Intellectual property

The App, Site, catalog, style descriptions, artwork, design and software are owned by Hairset or its licensors and protected by copyright, trademark and other laws. We grant you a personal, non-transferable, revocable licence to use the App on Apple-branded devices you own or control, in line with the App Store rules. “Hairset” and the Hairset logo are our trademarks. Renders made from your photo are yours to keep and share for personal, non-commercial purposes; you may credit Hairset but are not required to.

7. Third-party services

The Service relies on third parties, including Apple (distribution, payments, Sign in with Apple), our AI model provider and our purchase-management provider. Their services are governed by their own terms and privacy policies. We are not responsible for third-party services we do not control.

8. Suspension and termination

You can stop using the Service at any time and delete your account from the You tab (see Delete your account). We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service, in which case we will give reasonable notice where practicable. Sections 3, 5, 6, 9, 10 and 12 survive termination.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RENDERS WILL MATCH REAL-WORLD RESULTS, THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY RECOMMENDATION SUITS YOUR PERSONAL CIRCUMSTANCES.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HAIRSET AND ITS OFFICERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, INCLUDING ANY DECISION YOU MAKE ABOUT YOUR HAIR BASED ON A RENDER OR RECOMMENDATION. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$50.

Some jurisdictions do not allow certain exclusions; in that case these limits apply to the maximum extent permitted, and nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or rights that cannot be excluded by law.

11. Changes

We may update these Terms. The date at the top shows the latest version. For material changes we will notify you in the App or by email before they take effect. Continuing to use the Service after that date means you accept the new Terms; if you do not, stop using the Service and cancel any subscription.

12. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Hairset is established, without regard to conflict-of-law rules, except where mandatory consumer protection law in your country of residence gives you additional rights, which remain unaffected. Before starting any formal proceeding, you agree to contact us first so we can try to resolve the matter informally within 30 days.
